By bidding for any item included in the sale - the bidder confirms that he accepts and is
bound by the following terms and conditions .

1. Bids must be sent to Ryncor Auctioneers, on or before Friday, 31st October 2008

2. The seller is the sole owner of this property. Ryncor Auctioneers acts as agent for on behalf of the seller
and does not have any right title or interest in the ownership of these properties and does not accept any
liability to any third party with regard to this property.

3. A "tender sale" is a private treaty sale in which the seller reserves the right to refuse an offer at any time
without any justification or explanation. The seller reserves the right to withdraw his property from the sale.

4. 5% Buyers commission will be added to all bids - payable by the purchaser to Ryncor Auctioneers.

5. All bids will be assumed are exclusive of 14% VAT.

6. The purchase price shall be paid and secured by the purchaser as follows:

i) The purchaser shall lodge a deposit of 10% of the purchaseed price, along with an additional 5% buyers
commission and VAT applicable of 14% to the Auctioneers within 7 days of awarding the wining bids.

ii) The abovementioned payment to the Auctioneers shall be made to the following account:

iii) The purchaser will need to deliver guarantees to the seller within 30 days of awarding of the winning bid.

iv) The balanceof the purchase price together with VAT shall be paid by the purchaser to the seller upon
registration of transfer of the property into the name of the purchaser.

7. Occupation of the property shall be given to the purchaser upon registration of transfer of the property
into the name of the purchaser from which date all the risk in and to the property shall pass to the purchaser.

8. Should the purchaser fails to proceed to pay within the set time period or cancel his bid, Ryncor Auctioneers
will be entitled to a penalty fee amounting to 10% of the bid amount from the buyer.

9. If it appears that the property cannot be delivered by the seller, for any reason whatsoever,
Ryncor Auctioneers will be authorized to declare the sale void, after which Ryncor Auctioneers and/or
the seller will reimburse payments to the purchaser but will not be liable to pay any damage to the purchaser.

10.This property is sold “as is, where is”, with no guarantee as regards to condition. In any event, the
purchaser will be deemed to have carefully inspected the properties he purchases beforehand. The purchaser
will be deemed competent and to have been informed, of the existing conditions of the property and
acknowledge being acquainted with the property, its nature and extent before the closing date for biddings.
This includes any error in the descriptions as well as any flaw or imperfection of the properties.

11. Conveyance of property and the cost of the transfer will be entirely for the purchaser’s account and his
responsibility. Neither the seller nor Ryncor Auctioneers shall be liable to the purchaser or any third party for
additional expenses.

12. No responsibility whatsoever can be accepted by Ryncor Auctioneers with regards to quantity, quality,
dimensions and completeness of the properties as shown in the catalogue.

13.The seller is solely responsible for the correctness and clarity of the details and descriptions included
in the catalogue.

14.Pictures of the items as shown in the sales catalogue or sales lists are provided for the sole purpose of
better differentiation and under no circumstances do they represent properties or characteristics of the
properties for sale.

15.The purchaser declares to be duly entitled to sign and purchase the items himself or on behalf of his
company and agrees with the above-mentioned general conditions of sale by tender.

16.The purchaser warrants that the purchaser was introduced to the property by Ryncor Auctioneers.
